Court assessors comprising of Ms Jacqueline Nabuufu and Ms Nafula Jacqueline following their joint opinion that they had rendered to court on March 28, cleared that the evidence of the 16 prosecution witnesses didn’t place the accused Mr Abubakar Kalungi at the crime scene.
They weren’t convinced of the evidence presented involving the participation of the accused (Mr Kalungi) in the murder case involving former Buyende DPC late Muhammad Kirumira and Resty Nalinya Mbabazi.
They advised court to find the accused not guilty of the offences charged and acquit him accordingly.
However the opinions of the assessors doesn’t bind the judge in anyway and the judge may depart from it giving his or her reasons.
Further more, assessors also told court that the evidence brought before it indicated that Kalungi presented in court had bodily bruises which was a clear testimony that he was tortured into confessing in charge and caution statement to have participated in the murder of Kirumira.
Presiding over the case Judge Mutonyi told court that she will deliver her final judgment on April 24 ,a decision that will determine Kalungi’s innocence or guilt.
However it’s the prosecution’s case that on September 8 2018 in Bulenga trading centre, the accused and others still at large murdered Kirumira and his friend Mbabazi who were travelling in a saloon car were gunned down by unidentified goons travelling on motorbikes .
